Pension sharing on divorce
Here is my basic legal advice to clients about divorce pension sharing in Scotland ;
- I will obtain the pension transfer value from your pension provider and a note of their charges.
- I will apportion the correct amount of your pension value for the period of the marriage.
- The pension transfer value forms part of the total divorce wealth pot to be divided between to parties. Use my divorce wealth calculato
- If a pension share is required I will draft an agreement and have it approved by the pension provider.
- The other spouse needs to approve and sign the agreement.
- I can arrange your divorce and send the decree to the pension provider along with the agreement to implement transfer.
- If there is no agreement one party may raise a divorce & finance action at the Sheriff Court or the Court of Session.
- In my experience this is a complex matter, not least because there are so many different pension providers and they all process & charge in a variety of ways.
