House solutions on divorce
Here is my basic legal advice to clients about sorting out the family home for a divorce in Scotland ;
- What is the property value and what is the amount borrowed on the mortgage?
- You need to add this to the total wealth pot; see divorce wealth calculator
- If one of you wants to retain the house - can you take over the mortgage or seek to defer a sale ?
- If one of you wants to sell the house - have you had a quote from an estate agent ?
- And then it comes down to skilful negotiation and compromise ie you need my advice & legal expertise to reach agreement.
- If all else fails a court action of divorce may be required to encourage progress.
